California’s Department of Toxic Substances Control Announces Modified Rulemaking to List Nail Products Containing Methyl Methacrylate (MMA) Under the Safer Consumer Products (SCP) Regulations: The Public Comment Period Ends February 25, 2025. 

On February 10, 2025, California’s Department of Toxic Substances Control (DTSC) announced a modified rulemaking to list nail products containing methyl methacrylate (MMA) at concentrations greater than 1,000 parts-per-million as a Priority Product under the California Safer Consumer Products (SCP) Regulations. The scope of the regulation includes nail coatings and artificial nails that contain MMA. The modification to the proposed regulation changes the definition of the Priority Product to exclude nail products containing less than or equal to 1,000 parts per million (ppm) of MMA from the definition of the Priority Product. These changes eliminate the need for manufacturers of nail products that contain 1,000 ppm or less of MMA to comply with the Alternatives Analysis Threshold requirements as they are no longer subject to SCP regulations.  

The California SCP program is currently accepting public comments on the proposed rulemaking until February 25, 2025. toXcel, LLC is ready to assist in developing comments on the modified rule on behalf of companies that produce and distribute nail products containing greater than 1,000 ppm MMA.
